What is Indirect Customs Representation, and how can AD Customs take over my obligation to pay import VAT? - information

It is often difficult for importers to pay customs duties and import VAT (Value Added Tax) immediately for shipments they import. We strive to provide our customers with beneficial financing opportunities while reducing their administrative burden. To achieve this, we have expanded our service offerings to include indirect representation, in addition to our other customs representation services.

Indirect customs representation is when a representative acts in their own name but on behalf of another person. When we provide this service, we act in our own name (as AD Customs Kft.) but on behalf of the importer (our customer). We then become jointly liable for the customs duties, and can take over the obligation to pay import VAT from our customers.

This is set out in Paragraph 145 (2) of the Hungary VAT Act, which makes it possible for the import taxes to be paid during the import customs procedure by the indirect customs representative instead of the importer.

As part of an arrangement within the framework of the complex customs services we offer, our customers do not need to pay import VAT during customs clearances, and still remain compliant with the VAT act and other relevant customs legislation.
